Terms of Use

By registering with Elinet, the English Language Institute on the Internet, and / or accessing, ordering or using any number of web-based Elinet lessons or e-tests (the "Products") in any way or studying English or French via Internet video conferencing offered by Elinet language contractors, or by working as an Elinet contractor of any type, you become an Authorized User and agree to the following terms and conditions.

Terms & Conditions

1. License

a) Subject to the terms of this Agreement, Elinet Communications hereby grants you a non-exclusive, non-transferable temporary license to have access to and use the Products. As an Authorized User, you do not acquire any ownership interest or rights in the Products and associated materials and all such rights and interests remain with Elinet Communications and its licensors.

b) The Products are licensed solely for Authorized Users’ educational use. You represent and warrant to Elinet Communications that you will not use the Products or any material retrieved from the Products to create products or perform services which compete or interfere with the Products and services of Elinet Communications or its licensors, and that you will not use the Products or any material retrieved from the Products in any manner that will infringe the copyright or other proprietary right of Elinet Communications or its licensors.

2. Content

All English and French language certificate programs, trial lessons and other materials offered through this website are non-credit. Elinet is a private, web-based, non-post-secondary, educational language institution / tutoring centre registered with the government of the Province of British Columbia, Canada and offering a variety of English and French language services, including online tutoring and distance learning (e-learning or cyber-learning) using various technologies. In Canada, only public institutions (e.g. universities) are legally required to have their curricula approved by the government. Elinet student admission criteria are universal and do not restrict people of any specific age group or education level from enrolling in any of its programs.

3. Proprietary Rights

All intellectual property rights, including copyrights and other rights to any materials supplied to you by Elinet Communications will remain the sole and inseverable property of Elinet Communications or its licensors, and no title or license right is granted to you as an Authorized User, except for conditions of use as expressly set forth in this Agreement.

All original web-based Elinet lessons, Elinet e-tests, all other proprietary educational Elinet materials, and all content of the Elinet website are the copyrighted exclusive intellectual property of Elinet Communications and shall always remain the property of Elinet Communications regardless of the current or future status of any Authorized Users, whether registered or unregistered, with respect to Elinet Products or services, or the status of any other affiliated or non-affiliated persons.

The red and white Elinet logo is a registered trademark of Elinet Communications (Canada).

All Elinet teaching / learning materials, both original and those owned by Elinet contractors and used by them as part of their contract duties, are protected by copyright law and international treaties and shall remain the respective property of Elinet Communications and such contractors. All teaching / learning materials offered by Elinet Communications through this website, including all web-based Elinet lessons and e-tests, are licensed on a temporary basis and solely for personal and non-commercial use by registered Elinet students and unregistered guests who have been granted legitimate access to such materials, and under no circumstances shall such materials be used by them for the purpose of making profit.

No Elinet educational or learning materials, in whole or in part, or any information, software, technology, products or services obtained through and from the Elinet website may be displayed, performed, offered, broadcast, shared with other people, copied, downloaded, saved in any form, sent by email, reproduced, distributed, published, republished, licensed, modified, used for unauthorized teaching activities, used to create derivative works, materials or products employing the original Elinet teaching concept, stored in a retrieval system, sold, resold, or transmitted in any form or by any means, electronic, digital, mechanical, photocopying, sound recording or otherwise by registered Elinet students, Elinet website guests, or any other party without proper authorization.

Unauthorized reproduction, distribution or use of any Elinet materials, or any portion of them, are strictly prohibited under the law and will result in severe civil liability or criminal prosecution. Information about unlawful activities towards any part of the Elinet learning program is actively sought and collected worldwide so that perpetrators are prosecuted to the maximum extent possible under the existing legislation.

4. Licensors

Elinet lessons contain legally licensed media elements by Microsoft, Corel and Hemera that are used in accordance with terms and conditions stated by these companies on their websites. Elinet's Advanced Certificate Program contains certain copyrighted materials legally purchased from other sources. Fees charged for the lessons in the Advanced Certificate Program do not apply to such copyrighted materials; such fees cover the proprietary Elinet portion and tutor support services for each such lesson.

5. Contractors

All Elinet Tutors are native English or French speakers, certified ESL (English as a Second Language) teachers, or have completed other English or French language programs at recognized Canadian, British, US or other foreign colleges or universities, or hold other diplomas or certificates in English or French, or other appropriate teaching certificates.

6. Fees & Refunds

Fees for the Products shall be paid by users before accessing any Elinet materials. No refunds shall be issued for orders or services that have been provided.

7. Miscellaneous

The persons, events, firms and situations featured in Elinet lessons and test materials are fictitious. Any similarity to actual persons, living or dead, or to actual events, firms, or situations is accidental and unintentional.
